Last updated: May 2025
1. Introduction
These Terms and Conditions ("Terms") govern your use of the Polish website at polish.nz and your engagement with Polish services ("Services"). By accessing our website or engaging our Services, you agree to be bound by these Terms.
Polish is a New Zealand business. These Terms are governed by New Zealand law, including the Contract and Commercial Law Act 2017, the Consumer Guarantees Act 1993, and the Fair Trading Act 1986.
2. Services
Polish provides AI leadership development, executive coaching, workshops, keynote speaking, and related capability-building services. The specific terms of any programme or engagement are set out in a separate service agreement, proposal, or booking confirmation, which together with these Terms form the full agreement between you and Polish.
Polish reserves the right to modify, cancel, or reschedule any programme with reasonable notice. Where a programme is cancelled by Polish, participants will receive a full refund or the option to transfer to an alternative date.
3. Intellectual Property
All content on this website — including text, imagery, design, logos, programme materials, and frameworks — is the intellectual property of Polish and is protected by New Zealand and international copyright law.
You may not reproduce, distribute, modify, or use any content from this site without prior written permission from Polish, except for your own personal, non-commercial reference.
Programme and workshop materials provided to participants are for personal use only and may not be shared, reproduced, or used for commercial purposes without written consent.
4. Website Use
You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:
- Attempt to gain unauthorised access to any part of the website or its underlying systems

- Use automated tools to scrape or harvest content from the website
- Misrepresent your identity or affiliation when submitting enquiries
5. Accuracy of Information
We make reasonable efforts to ensure the information on this website is accurate and up to date. However, we do not warrant that all content is complete, current, or free from error. Programme details, pricing, and availability are subject to change without notice.

6. Limitation of Liability
To the fullest extent permitted by law, Polish will not be liable for any indirect, incidental, or consequential loss or damage arising from your use of this website or engagement with our Services, including but not limited to loss of revenue, data, or business opportunity.
Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, or excludes liability that cannot be excluded by law.
Where Services are acquired for business purposes, the Consumer Guarantees Act 1993 may not apply.
7. Third-Party Links

8. Privacy
Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.
9. Confidentiality
Both parties agree to keep confidential any sensitive business, strategic, or personal information disclosed during the course of an engagement. This obligation survives the end of any service agreement.
10. Dispute Resolution
If a dispute arises in connection with these Terms or our Services, the parties agree to first attempt to resolve the matter through good-faith negotiation. If the matter is not resolved within 20 working days, either party may refer the dispute to mediation before initiating legal proceedings.
These Terms are governed by the laws of New Zealand. The courts of New Zealand have exclusive jurisdiction over any dispute arising from these Terms or your use of our website.
